Unlike big Japanese corporations, which tend to conduct unilateral termination or voluntary retirement only occasionally, foreign companies frequently employ such methods to respond to employees with poor performance or attendance and achieve reductions in their workforce in line with the business performance of their company or the changes in global business strategies. We assume that the persons in charge of the General Affairs, Human Resources, and Legal departments at many corporations are employing these methods.
However, these methods come hand-in-hand with the risk of potential disputes, so such methods need to be employed based on the understanding of key points concerning the voluntary retirement and unilateral termination from the perspective of Japanese labor laws. Similarly, such methods need to be employed while taking into consideration the systems and business practices concerning the dispute resolution that may follow such voluntary retirement or unilateral termination. In addition to understanding such systems and risks, it is essential from a business perspective to explain the general characteristics of the Japanese labor market in details to the persons in charge at headquarters or APAC regional headquarters outside Japan, to whom reporting is often required, to ensure their understanding of such characteristics.
As the first seminar in our legal seminar series for foreign companies, the speaker will discuss the points to consider concerning the voluntary retirement and unilateral termination with those of you who belong to the General Affairs, Human Resources, and Legal departments, among others, of foreign companies.
