The Interactive Arbitration Rules (effective from January 1, 2019 and amended on July 1, 2021) of the Japan Commercial Arbitration Association ("JCAA") encourage an interactive "dialogue" between the parties and the arbitral tribunal. This approach allows the parties to understand the disputed issues and the preliminary views of the arbitral tribunal at an early stage, thereby promoting an early resolution of the dispute. In terms of arbitration costs, the arbitrators' remuneration is fixed at a reasonable amount based on the value of the dispute, making costs more predictable for the parties.

In this seminar, lawyers well experienced in international and domestic institutional arbitration, including at the JCAA, will explain the key features of the Interactive Arbitration Rules, and how the parties can use them. An actual case study demonstrating how the rules were applied will also be discussed.

The seminar will be conducted alternately in English and Japanese. No simultaneous interpretation will be provided, however, the slides will be prepared in both English and Japanese, and the English discussions will be summarized in Japanese.
